Pedestrian deaths are on the upswing in Stuart & Port St. Lucie

on roadway, hand with cellphone just out of reach

According to a report released by the Governors Highway Safety Association in 2019, an estimated 6,227 pedestrians were killed in 2018, an increase of 250 from 2017. Pedestrian fatalities in the U.S. have increased 41-percent since 2008 and now account for 16 percent of all traffic fatalities, the Association says.

Why?

  • Pedestrians not walking in safe areas without drivers
  • Bad weather conditions
  • Time of day (night-time walking versus day-time)
  • Age (younger and older walkers are less attentive, on the whole)
  • Driving and/or walking under the influence
  • Distracted walkers (texting, speaking on the phone, wearing noise-killing earphones)

If you have been hit by a car while walking,

  • Call the police
  • Don’t discuss the accident with bystanders on the scene or with the driver’s insurance company
  • Contact your own insurance company
  • Consider seeking advice from an attorney

There are common sense things that any pedestrian who has been struck by a car must do in order to protect yourself, your legal rights, and your future.

  • Seek medical assistance immediately even if you don’t think you’re injured
  • Make a list and take photos of injuries, list where you have pain, save torn clothes
  • Call the police even if you think the accident was minor
  • Make a list of details leading up to and around the accident – you may have forgotten them later when it’s important to be specific

Last but not least, consider seeking professional legal assistance. Injuries you received may lead to physical, emotional and financial difficulties that will seriously impact your life.  In most instances, the motorist’s insurance company will attempt to place fault on you and deny your claims.

A qualified personal injury attorney like Gloria Seidule will ensure that your legal rights, quality of life and livelihood are protected.
