Elevator law in Florida states the owner of the premises where the elevator is located has a non-delegable duty to deep the elevator reasonably safe for people using the elevator. The owner of the premises also has a duty to warn that the elevator is unsafe.
How are elevators unsafe? Elevators can fail to properly level when the door opens. Elevators can lurch. Elevators can plunge down with people onboard. Elevators can fail to open trapping people inside.
Pursuant to Florida Law, the elevator owner is responsible for the safe operation, maintenance, inspection and correction of code deficiencies. Failure to comply with Florida Statute 399.02 is negligence per se, which means if the owner is found to have violated this statute, then the owner is liable for any injury to a person using the elevator.
