Bar Shooting Liability

An innocent concert attendee was shot and killed at a show at a bar known for violence and prior shootings. The owner of the premises where the bar is located leased to a tenant who operated the bar. The performer promoted the act depicting violence, guns and fighting and had been shot at a show 7 months before this show. The Estate of the Deceased sued the owner of the premises, the tenant who operated the bar and the performer who promoted violence. Who is liable? FACTS: The owner had a lease putting the responsibility for security for the exterior of the building on the owner . The lease put the responsibility for security for the interior of the building on the tenant. The performer recorded a promotional video that depicted a shooting at a concert. The police had cited the building owner for lack of crowd control in the parking lot of the building after a prior shooting. The police had cited the tenant for failing to prevent firearms inside the building after a prior shooting. The shooting occurred in the parking lot when the deceased was leaving the concert after a fight broke out inside the bar. The concert attendee was accidently caught in crossfire. The shooter was never found. The shooter is not on the verdict form. There was no evidence the deceased concert attendee knew of any of the prior shootings or had seen the violent promotional video.
