A trip over a homemade pedestal in a clothing store resulted in a settlement for a client of Gloria Seidule. The defendant denied the fall even occurred forcing the case into litigation.
The pedestal was designed to allow a person to step on it to stand in front of a mirror. However, the pedestal was the same color as the carpet, and the client did not see it and tripped over it and injured her shoulder. She had two surgeries and ended up with a less than desirable result.
Once in litigation, several depositions were taken successfully proving the client did in fact trip over the pedestal. An expert was hired to evaluate the reasonableness of the pedestal design. The case settled on the eve of trial.
